Facebook What Can I Do When My Insurance Company Not Responding to My Claim? Skip to main content

At The Morgan Law Group P.A., our Puerto Rico, Louisiana, Mississippi, California, and Florida insurance claims attorneys know that insurance company adjusters have obligations to promptly respond to communications from their policyholders.

Unfortunately, there are times when our clients are simply not getting the answers they are entitled to when their home, condominium, or business has suffered damage from a fire, hurricane, or flood that impacted their sole property or the entire geographical area.

Here are a few tips to document your claim and solicit a response.

Document All Contact Regarding Your Insurance Claim

From the very first call, start documenting your correspondence with the insurance company. Even if you leave a message, write down the date and time you left it. Going forward, record each point of contact — whether it was phone, online, or email — and what the response was, even if there was no response.

This will provide a chain of events to back up the date you began pursuing your claim.

Contact Your Insurance Representative’s Supervisor

If you have been relegated to calling your insurance company’s 800 number and leaving message after message for your point of contact, only to never hear back, try someone else.

Contacting a supervisor may move your claim forward quicker and without too much trouble.

You can then report all the times you have tried to contact your representative based on the records you have kept to date.

Report the Insurance Company to Your State Department of Insurance

If you are having a challenging time getting results from your insurance provider, you can file a complaint with the state department of insurance in Florida, Louisiana, Mississippi, California, or Puerto Rico.

Filing a complaint may not produce real-time solutions but instead, expose your insurance provider to scrutiny from the state agency going forward.

File a Lawsuit to Get the Insurance Company to Respond

The final approach to getting the response you require is filing an insurance claim lawsuit.

When you file a lawsuit, the insurance company is served paperwork that legally requires them to answer and begin the process of resolving your case.
